摘要
CleanDevelopmentMechanism(CDM)hasgivenbirthtoaninternationalcarbontradingmarketprosperity,whichprovidesdevelopingcountrieswithvaluableopportunitytoaddressclimatechangeissuesrightalongwitheconomicdevelopmentandenvironmentalimprovementtoachievesustainabledevelopment.However,moststudiesofCDMfocusoneconomics,andfewonitslegalproblems.CDMinvolvestoomanyaspects.Andtheclearlegalattributeoftradingobjectisthebasisofprogressofthetransactionandalsothestartpointoflegalprotection.Therefore,thispaperinaccordancewiththeinherentprincipleofpropertyrightseconomics,andenvironmentaleconomicsinCDM,onlydiscussesCDMcarbonemissionrightlegalinterpretationanditsattribution.Thepaperrecommendsthatinordertoensureandpromotethecarbonemissionrighttrading,carbonemissionrightshouldbeattributedintothesystemofrealrightstoberegulatedbyRealRightLaw.Inthisway,carbonemissionrightcangainexclusivepowerofpossessionanduse,whichcanachieveaclearrightdefinitionofenvironmentalgoodsinlinewithCoase'stheorytoprotectChineseprofitincarbontradingmarketandpromotethedevelopmentofthecarbontradingmarketfurther.
